About the Role
We are seeking a Senior Legal Counsel, Americas - Commercial and Employment to join the Medical Legal Compliance and Data Privacy (LCDP) Team. In this organization, the Senior Counsel, Americas - Commercial and Employment will partner with regional and global Medical commercial leadership, the Medical HR team and the Medical LCDP team to advise and counsel on a wide variety of commercial and employment legal matters within the Americas region, in partnership with internal and external legal resources. This position offers flexible work arrangement options, including on-site at our facility in Flagstaff, Arizona, hybrid or fully remote in most locations within the United States.
Responsibilities
Commercial
- Provide day-to-day legal advice and manage delivery of legal services for commercial matters within the Americas region of the Medical operating company, including structuring, drafting, and negotiating a wide range of commercial legal documents, such as contracts, term sheets, letters of agreement, policies, processes and other documents
- Identify opportunities to improve contracting processes, risk management, and legal operations related to commercial activities
Employment
- Serve as primary internal counsel and day-to-day employment law advisor for the Americas region employment legal matters, including agency complaints, audits, demand letters and legal claims with consultation and engagement with outside counsel as appropriate and performance, discipline, hire, termination and job elimination or reduction
- Partner effectively with HR, the business, and internal litigation team to address and coordinate employment legal matters and litigation
- Advise clients on compliance with state and federal employment laws, including Title VII, ADA, FMLA, and FLSA
General
- Understand, identify, and clearly articulate legal risks and conduct sound legal analysis based upon the applicable law, pertinent facts and circumstances appropriately framed in the context of business goals and objectives, including legal guidance for due diligence, integration, and other aspects for mergers and acquisitions
- Build strong, collaborative relationships with internal business and functional partners to assess and mitigate legal risk while enabling business objectives and is accountable for the management of outside counsel and consultants
- Associate has a track record of delivering outstanding results in new and tough situations
- Actively foster and support an environment of inclusion, authenticity and humility
- Communicate directly with fellow Associates to resolve challenges regardless of their role or difference of opinion
Required Qualifications
- Juris Doctor degree from an accredited law school
- License to practice law
- Minimum of 5 years of experience in general commercial and transactional law, with medical device or life sciences company experience preferred
- Demonstrated track record of providing operational advice and counsel to business leaders
- Experience in global supply and procurement preferred
- Excellent communication and interpersonal skills, strong judgement, and risk assessment skills
- Ability to influence decision making to manage operational risk, manage complex projects, processes and teams with limited supervision
- Ability to travel up to 10%
Desired Qualifications
- Prior experience in employment law or related legal fields
- Familiarity with state and federal labor law
- Ability to communicate complex legal concepts and risk effectively
