Ensures compliance with all Youth Services regulatory requirements, contractual obligations, and organizational procedures.

MAJOR RESPONSIBILITIES & DUTIES:

  • Ensures compliance with regulatory requirements and contractual obligations.
  • Develops, initiates, maintains, and revises policies and procedures for the general operation of the Compliance Program and its related activities to prevent illegal, unethical, or improper conduct.
  • Collaborates with other departments (e.g., Legal, Risk Management, Program Audit, Human Resources, etc.) to direct compliance issues to appropriate existing channels for investigation and resolution. Consults with the corporate attorney as needed to resolve legal compliance issues.
  • Responds to alleged violations of rules, regulations, policies, procedures, and Standards of Conduct by evaluating or recommending the initiation of investigative procedures. Develops and oversees a system for uniform handling of such violations.
  • Acts as an independent review to ensure that compliance issues/concerns within the organization are being appropriately evaluated, investigated and resolved.
  • Monitors, and as necessary, coordinates compliance activities of other departments to remain abreast of the status of all compliance activities and to identify trends.
  • Identifies potential areas of compliance vulnerability and risk; develops/implements corrective action plans for resolution of problematic issues, and provides general guidance on how to avoid or deal with similar situations in the future.
  • Ensures proper reporting of violations or potential violations to duly authorized enforcement agencies as appropriate and/or required.
  • Institutes and maintains an effective compliance communication program for the organization, including promoting (a) use of the Compliance Hotline; (b) heightened awareness of Standards of Conduct, and (c) understanding of new and existing compliance issues and related policies and procedures. Establishes and provides direction and management of the compliance Hotline.
  • Works with the Human Resources Department and others as appropriate to develop an effective compliance training program, including appropriate introductory training for new employees as well as ongoing training for all employees and managers.
  • Monitors the performance of the Compliance Program and relates activities on a continuing basis, taking appropriate steps to improve its effectiveness.
  • Pilots, recommends, and develops procedures as needed.
  • Provides feedback to departmental directors and other staff to help them develop controls, systems for monitoring and prepare for external or internal audits.
  • Reviews all program contracts on a yearly basis to ensure contracts remain in the best interest of Boys Town Youth Care; makes recommendations to YC Leadership Team regarding the contract reviews.
  • Develops and adheres to a clear risk universe that outlines all of the known laws and regulations that impact the organization. Utilizes the risk universe to do an ongoing risk assessment to rank the laws, regulations and requirements by evaluating them on a scale of likelihood to impact. Continuously reviews and updates the risk assessment to ensure the highest risks are captured.
  • Utilizes the risk assessment rankings to create a specific compliance work plan to outline compliance monitoring and auditing efforts. Updates the workplan on an ongoing basis to ensure the highest risks are addressed.
  • Conducts the monitoring and auditing outlined in the Compliance work plan and provides written, detailed metrics and reports on the monitoring. Utilizes the information from the monitoring and auditing efforts to develop, in collaboration with operational areas, mitigation plans for all open items.
  • Maintains a list of current open items, the mitigation plans and the progress along the mitigation plans. Provides regular reporting to leadership and the Director of Organizational Compliance.
  • Helps guide strategic implementation of regulations that may not yet be implemented but could have serious consequences for applicable programs.
  • Responds to compliance questions using the general IRAC response outline.
  • Relates to the National Board Youth Care Committee.
  • Ensures Youth Care compliance with Government regulations; resolves compliance issues, review action plans, and monitors effective of action plans.
  • Ensures the Director of Organizational Compliance is provided with necessary information to inform the National Board Youth Care Committee of significant events, obstacles towards institutional compliance including new or changes in regulations and/or trends.
  • Serves as a staff member of the National Board Youth Care Committee.
  • Works with government agencies and contacts to respond to inquiries, issues and surveys.

KNOWLEDGE, SKILLS, AND ABILITIES:

  • Thorough understanding of budgetary and financial analysis principles.
  • Knowledge of regulatory requirements pertaining to youth care.
  • Knowledge of strategic planning, resource allocation, leadership technique, and coordination of people and resources in a non-profit organization.
  • Ability to communicate at all levels in the organization and with external business contacts in an articulate, professional manner while maintaining necessary degree of confidentiality.
  • Ability to successfully lead a team of associates.
  • Knowledge of Boys Town Model.

REQUIRED QUALIFICATIONS:

  • Bachelor's degree in business, management, related field, or equivalent combination of education and experience required.
  • Minimum of 7 years of experience including compliance and management required.
  • Able to meet the travel requirements for the position required.

PREFERRED QUALIFICATIONS:

  • Master's degree preferred.
  • Compliance certification preferred.

PHYSICAL REQUIREMENTS, EQUIPMENT USAGE, WORK ENVIRONMENT:

  • Position is relatively sedentary in a normal office administrative environment involving minimum exposure to physical risks. Will use office equipment such as a computer/laptop, monitor, keyboard, and a general workstation set-up.
