Shift: Days 8:00 AM - 4:30 PM. No weekends.

GENERAL SUMMARY:

Responsible for the oversight of the organization operating in compliance with Recipient Rights regulations and standards. Supports and advocates for patients in navigating all aspects of Recipient Rights and the Mental Health Code.

Responsibilities:



  • Safeguards the rights guaranteed by the Mental Health Code through activities of prevention, monitoring and education of hospital staff, volunteers and contract providers. Follows up as appropriate to ensure recipients of mental health services obtain resolutions when rights have been violated.
  • Reviews and acknowledges complaints made on behalf of recipients. Assures that an intervention or investigation is initiated when a complaint indicates a potential violation of rights has occurred. Acts to resolve allegations of rights violations as specified by the Mental Health Code and contractual requirements. Conducts investigation as required by law, determines responsibility for rights violations and makes recommendations to the hospital director in a timely manner for remediation and to prevent recurrences. As necessary, assists the complainant or recipient with the appeal process to the Community Mental Health or Department of Community Mental Health appeals committee. Assures adherence to proper due process procedures required for appeals.
  • Reviews and monitors information through chart review, incident report review, etc., for patterns and trends. Conducts investigations, prepares and securely maintains related documentation and evidence. Conducts investigations, as appropriate, regarding circumstances around the death or serious injury of a recipient or other potential rights violations that may be identified in incident reports. Provides guidance and consultation as to standards, policies, procedures and regulations related to recipient rights. Assure adherence to proper due process procedures.
  • Prepares a semiannual and annual report of rights activity for review by the Advisory Committee, regulatory agencies and Board. Provides advocacy support to patients and their families.
  • Conducts planned and unplanned site visits, validates utilization of recipient rights materials, documents deficiencies, and acts to monitor remedial action to resolve deficiencies adhering to defined regulatory methods and timeframes.
  • Serves as a source for consultation and education of patients, staff, providers, agency or contract associates on the organization's policies and procedures and the Mental Health Code. Provides support with navigations in the healthcare system. Responsible for providing and/or validating Recipient Rights training compliance for all employees, contract providers, agency, students, Advisory Committee, and etc.
  • Works cooperatively with outside agencies, such as the state protection and advocacy system, family independence agency, state departments, community mental health service providers and local law enforcement agencies to ensure the protection of rights of recipients being served by the facility. Reviews contracts advising compliance requirements.
  • Analyzes complaint data and reports from accrediting agencies, develops or assists in preparation of reports for appropriate leadership. Participates and acts as recipient rights liaison in advisory committees, work groups, and process improvement teams.


EDUCATION/EXPERIENCE REQUIRED:



  • High School diploma equivalency
  • A minimum of one year's professional experience in investigation and advocacy within a private or public human services agency (or comparable experience) required.
  • Working knowledge of the Mental Health Code and the ability to interpret and apply statutes, rules, policies and procedures is helpful,but not required.
